USER AGREEMENT

1. Software and related services

This Agreement governs access to and use of the TraksPet application, the associated website, servers, Pet Tracker device firmware, software updates, and any other related service provided by the manufacturer or its authorized distributors.

The services include, among others:

• Account registration and management.
• Device linking and management.
• Real-time GPS tracking.
• Route history.
• Geofences (GeoFence).
• SOS alerts.
• Lost Mode.
• Voice calls and video calls.
• Device sharing between users.
• OTA (Over The Air) updates.
• Cloud storage and synchronization services.

The provider may modify, improve, or add new services when necessary.

2. Account registration, use, and security

An account must be created to use certain features.

The user agrees that:

• All information provided will be truthful and up to date.
• The user is responsible for maintaining the confidentiality of their credentials.
• The user is responsible for all activities carried out through their account.
• The user must immediately report any unauthorized access.

The provider may temporarily suspend an account upon detecting fraudulent activity, misuse, or a breach of this Agreement, and will inform the user of the reason for the suspension.

3. Protection of personal information

Personal data will be processed in accordance with the Privacy Policy.

The application may collect information necessary for its proper operation, including:

• Registration data.
• Pet information.
• Device information.
• Location data.
• Activity logs.
• Technical and diagnostic information.

This data will be processed solely to provide, maintain, and improve the services offered.

4. User rights and obligations

The user undertakes to:

• Use the application in accordance with applicable law.
• Not use the service for illegal activities.
• Not alter, modify, or attempt to compromise the security of the software.
• Not use the application to harm third parties.
• Not use the device to locate or track people without their consent.
• Keep the device firmware up to date when new versions are available.

The user will have the right to:

• Access the contracted services.
• Manage their devices and pets.
• Request deletion of their account.
• Access, correct, or delete their personal information in accordance with the Privacy Policy.

5. Changes to the service, interruptions, and termination

The provider may:

• Update the software.
• Modify features.
• Improve the platform.
• Temporarily suspend services for maintenance.
• Interrupt certain services when security risks exist.

Whenever possible, notice of such interruptions will be given in advance.

In the event of permanent discontinuation of the service, the provider will give reasonable advance notice and allow the user to download their information before shutdown.

The provider may terminate access when:

• The user breaches this Agreement.
• Fraudulent use is detected.
• Legal obligations require it.

6. Intellectual property

All content related to the App is the property of the manufacturer or its licensors, including:

• Application.
• Software.
• Firmware.
• Design.
• Databases.
• Logos.
• Trademarks.
• Manuals.
• Videos.
• Photographs.
• Technical documentation.

No part may be copied, distributed, modified, or commercialized without written authorization.

Content uploaded by the user to the application, such as photographs, notes, and comments, will remain the user's property. The user grants the provider a limited, non-exclusive, and revocable license to store and process it solely for the purpose of providing the service.

7. Disclaimers and limitation of liability

The user understands and accepts that:

• GPS services depend on mobile networks, GPS satellites, operator availability, and signal coverage.
• The displayed location may be delayed or inaccurate. The margin of error varies: under clear-sky conditions it is a few meters, while indoors, among tall buildings, or in areas with poor coverage it may increase significantly.
• Voice and video calls depend on the quality of the available network.
• Notifications may be delayed due to external conditions.
• The provider does not guarantee uninterrupted availability of the service.

The SOS Alerts feature and location service do not replace emergency services. In an emergency, the user must contact the emergency services in their country. The service must not be used as the sole means of safeguarding the pet's well-being or as a security system for persons or property.

To the fullest extent permitted by applicable law, the provider will not be liable for:

• Indirect loss of information.
• Damage resulting from service interruptions not attributable to the provider.
• Problems caused by third parties unrelated to the provider.
• Misuse of the device.
• Unforeseeable events or force majeure.

The foregoing limitations apply only to the extent permitted by the laws of the user's country of residence and in no event limit, condition, or exclude any non-waivable rights that such laws grant to consumers, including statutory warranties covering the product.

8. Provisions applicable to minors

Minors may use the application only under the supervision and authorization of their parents or legal representatives.

The legal representatives will be fully responsible for use by minors.

Where applicable, the provider may delete information collected concerning minors if no valid authorization exists.

9. Governing law and dispute resolution

This Agreement will be governed by the law of the user's country of residence where that law is mandatory and, in all other cases, by the law determined by the provider for distribution of the service.

The parties will attempt to resolve any dispute through direct negotiation.

Where that is not possible, the dispute will be submitted to the competent courts in accordance with applicable law. The foregoing is without prejudice to the right of a user who qualifies as a consumer to apply to the courts and consumer-protection bodies of their place of residence, where the law recognizes that right.

If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions will remain in full force and effect.

Acceptance of the Agreement

By downloading, installing, registering for, or using this application, the user declares that they have read, understood, and fully accepted this User Agreement and the associated Privacy Policy.

The User Agreement and Privacy Policy will be presented in advance and made accessible during the registration process, and the user may consult and download them at any time from the application's “Legal” section.
